In a significant legal development, a court in New Mexico has mandated that Meta allocate $567 million to a fund designated for addressing the mental health issues purportedly resulting from its social media platforms’ impact on children. This decision follows a jury’s verdict in March, which concluded that Meta played a knowing role in harming children’s mental health and did not sufficiently tackle the issue of child sexual exploitation on its platforms. The recent court order brings Meta’s total financial liability in this case to $942 million.
Of the $567 million directed in the latest judgment, $420 million is earmarked for mental health treatment services targeted at young individuals in New Mexico. The remainder will fund initiatives such as prevention and awareness programs, screening services, and other supportive measures over a five-year period. Additionally, the court has instructed Meta to enhance child-safety protocols on its social media services, Facebook and Instagram. These enhancements include better age-assurance systems, clearer communication regarding safety and privacy features, and strategies to identify users potentially under the age of 13.
Meta is also obliged to collaborate with educational institutions or child-safety organizations to devise a system for reporting accounts that might belong to users under 13 years old. Furthermore, the company must purge any personal data collected from these younger users and submit biannual compliance reports to demonstrate adherence to the court’s mandates. Although the court considered implementing universal age verification exclusively in New Mexico, it ultimately refrained due to fairness concerns and existing federal privacy regulations protecting children.
Despite the ruling, Meta has expressed its opposition and intends to appeal the decision. The company asserts its commitment to user protection and highlights efforts already undertaken to address harmful content and enhance online safety. This case contributes to the mounting legal scrutiny Meta faces regarding allegations that its platforms may negatively impact young users. Similar legal actions are underway in various other states across the United States.
